2. Acceptance
By downloading, installing or using Hepaly, the adult responsible for the child accepts these Terms of Use and our Privacy Policy. The app is intended to be installed and configured by a parent or responsible adult.
3. License
Provided you comply with these terms, we grant you a limited, non-exclusive, non-transferable and revocable license to use Hepaly for personal, family and non-commercial purposes on Apple or Android devices you own or control.
4. App Store and Google Play conditions
Hepaly is distributed through Apple’s App Store on iPhone and iPad. These terms are between you and Vision Publishing LLC, not Apple. Apple is not responsible for the app or its content. If these terms conflict with Apple’s standard End User License Agreement or mandatory Apple requirements, Apple’s terms prevail to the extent of that conflict. Apple and its subsidiaries are third-party beneficiaries of these terms.
Hepaly is distributed through Google Play on Android. If these terms conflict with mandatory Google requirements for apps distributed through Google Play, Google Play’s terms prevail to the extent of that conflict.
5. Discovery period and subscriptions
Hepaly offers seven days of discovery without a card or subscription. Afterward, a parent can choose a monthly plan at US$13.99 or an annual plan at US$39.99 to continue. The App Store or Google Play provides local prices before confirmation. No payment starts automatically when the seven days end.
Payment is confirmed in the App Store or Google Play after entering the parental code. The annual plan is charged once per year. Subscriptions renew automatically unless canceled in the store’s settings before renewal. Access continues until the paid period ends. There is no second free trial when purchasing.
Both plans include the same activities. A parent account links verified purchases and restores Premium on iPhone, iPad or Android. Purchases remain managed by their original store. Notebooks can be restored if the parent enabled optional backup.
Adventures, practice, drawing, music and built-in coloring pages work offline during discovery or with a verified subscription. Internet is needed to purchase, restore and periodically verify access, and for magic coloring. Android requires a new verification after no more than 72 hours offline.
5a. Parent sign-in and external access
If you already have external Premium access, restore it with the associated email address and a confirmation code. It provides the same activities on supported devices while valid, without another in-app purchase. Its terms, price, any free period and renewal are those accepted separately when subscribing. Signing in by email alone does not create a payment.
The app does not initiate external purchases. Buying a workbook does not automatically grant Premium: access comes only from offers explicitly activated and assigned. Parent sign-in is personal; never share the code received. Notebook backup is optional, explicitly authorized by the parent and linked to their account. Apple or Google can also be used to sign in; use the same parent account or link the provider from that account. External access requires online verification within 72 hours offline. The parent account can be deleted immediately without canceling the subscription; cancellation must be requested from the relevant provider.
5b. Optional offer on hepaly.com
When available, the offer linked to a workbook purchase includes 30 free days, then €13.99 per month including tax, with automatic renewal. A separate, initially unchecked option must be selected. The app subscription is independent of the PDF club and its three volumes. The confirmation email and order area provide the exact trial end date, download links and cancellation instructions. Sign in to the app with the exact email used for payment. You do not need to buy another subscription in the store for this access.
Cancel before the next renewal to stop future charges. You also have a 14-day right to withdraw from this service: the app-subscription withdrawal option in your order area ends this contract immediately at no cost during that period. Any waiver relating to the PDFs does not apply to this subscription. Statutory guarantees remain applicable.
6. Role of the adult
- The adult creates the profiles, chooses the age and time of use, and defines the parental code.
- The adult accompanies children ages 3–5. Before age 3, the activities are for the adult to share with the child away from the screen.
- It keeps the parental code confidential. This code protects the ordinary interface; it does not constitute a safe or data encryption.
7. Magic coloring
Magic coloring turns a written idea into a line drawing using AI. Prompts are filtered, but results are generated automatically and may be imperfect or differ from the idea. Do not use the feature to reproduce protected characters or works, or request inappropriate content. Daily limits apply. The service may be unavailable or paused, including for maintenance or when capacity is reached; the 15 built-in coloring pages remain available during the access period.
8. Educational content
Hepaly draws on principles from research and public guides cited in the app. These sources concern learning principles; they do not prove the effectiveness of Hepaly itself, which has not undergone its own study. Hepaly does not replace school or specialist medical, speech-language or educational advice.
9. Data and deletion
Notebooks stay on the device when backup is off. A parent can enable syncing, correct or erase them. Deleting the account erases its online copy, signs out sessions and removes notebooks from the device used. See the removal procedure. A local offline copy or export must be deleted separately.
10. Intellectual property
Hepaly, its software, text, illustrations, characters including Milo the fox and Luma the firefly, brand and website content belong to Vision Publishing LLC or its licensors. Drawings and coloring created by a child belong to that child.
11. Availability and modifications
We may change, suspend or discontinue all or part of the app, including magic coloring, for technical, legal or security reasons.
12. Exclusion of warranty
Hepaly is provided “as is” and “as available,” to the extent permitted by law. We do not guarantee uninterrupted availability or a complete absence of errors. Your mandatory consumer rights are not affected.
13. Limitation of liability
To the extent permitted by law, Vision Publishing LLC is not liable for indirect, incidental, special or consequential damages related to the use of Hepaly, including loss of data stored on the device.
14. Termination
You may stop using Hepaly at any time. Deleting the app or notebook does not cancel a subscription: cancel it in the App Store or Google Play settings. Refund requests follow the store’s procedures and your legal rights. We may restrict magic coloring in cases of abusive or automated use.
15. Applicable law
These terms are governed by the laws of New Mexico, United States, without regard to conflict-of-laws rules, unless mandatory consumer protection laws in your country of residence provide otherwise.
